New York Judge Puts Hold on Mandatory Flu Shots



NEW YORK (CNN) -- A New York state Supreme Court judge Friday granted a temporary restraining order against a requirement that all health care workers in the state get H1N1 flu vaccinations.

New York wants all health workers to get flu vaccines.

The state health commissioner had said the workers had to be vaccinated against both seasonal and H1N1 flu by November 30 or risk disciplinary action.

The Public Employees Federation filed suit, and Judge Thomas McNamara on Friday granted the restraining order, which will be in effect at least until the State Supreme Court can review the case during a hearing scheduled for October 30.

In a news release, federation President Kenneth Brynien called the decision "a big step in the right direction."

Peter Banks, a council leader for the organization, added that its members "are not against the vaccination program; what we are against is the mandating, putting conditions of service over an unproven vaccine."

A state health department release said officials "are confident that the regulation will be upheld." It cited a 1990 court ruling that rejected health care workers' opposition to mandatory rubella vaccinations.

Banks noted that ruling "allows a philosophical or religious opt out," which he said is lacking in the emergency H1N1 regulation.

The Public Employees Federation is the second largest state employers union. It has 15,000 members who work in health care, approximately 5,000 of whom would be directly affected by the vaccination regulation.

5 Important Thoughts Regarding "Political Prosperity"

Safety and security is on everyone's mind these days. I find these thoughts to be enlightening and comforting, therefore useful for emotional well being.

• You cannot legislate the poor into prosperity by legislating the wealthy out of prosperity.

• What one person receives without working for, another person must work for without receiving.

• The government cannot give to anybody anything that the government does not first take from somebody else.

• When half of the people get the idea that they do not have to work because the other half is going to take care of them, and when the other half gets the idea that it does no good to work because somebody else is going to get what they work for, that my dear friend, is the beginning of the end of any nation.

• You cannot multiply wealth by dividing it.

British Immigrant, 17, Denied US Citizenship After Refusing HPV Gardasil Vaccine

Simone Davis, a 17 year old British immigrant, was abandoned by her mother while still a baby and now lives with her paternal grandmother in Port St Joe, Florida. Because Simone has refused to take the controversial HPV vaccine, Gardasil, she has been denied citizenship. HPV vaccine is required of all female immigrants to the United States.

In the article "Despite Debate, Reactions to the HPV Vaccine Rare", published in the August 19, 2009, Glove and Mail, it was revealed that 23 million doses of the HPV vaccine have been administered to young women in the United States, resulting in 32 deaths, 12, 424 adverse reactions, including 772 severe reactions (blood clots, pancreatic failure, motor neuron disease and anaphylaxis).

According to Barbara Loe Fisher of the National Vaccine Infomation Center, "The right to informed consent, to using a pharmaceutical product that carries (a warning of) the right of injury or death is a human right, and this young woman should not be denied the fight to become a US citizen simply because she does not want to be required to take this vaccine asa condition of becoming a US citizen. HPV infections is almost entirely preventable with Pap smear screens, which have been a routine part of health care in the US since the 1960's. It is absolutely unjustified to force women mammograms in this country to use a pharmaceutical product like Gardasil vaccine that carries risks that are not totally known yet."

Adverse Reactions to the HPV Vaccine Spark Demand for Inquiry

The Alliance for Natural Health-UK has called for an urgent scientific inquiry inot the HPV (human papilloma vaccine) being used in the United States. Pulse of Health Freedom recently wrote of the British teenager denied US citizenship after she refused the Gardasil vaccine, which is required of all female immigrants applying for citizenship.

British health authorities are now investigating the death of a 14 year old British schoolgirl a few hours after she received Cervarix vaccine at her school. Just days after another 17 year old British teen received the vaccine, she suffered seizures and damage to her left brain.

As reported in the September 29, 2009 issue of this newsletter, the Canadian newspaper, Globe and Mail revealed in August 2009 that 23 million doses of the HPV vaccine have been administered to young women in the United States, resulting in 32 deaths and 12,424 adverse reactions, including 772 severe reactions (blood clots, pancreatic failure, motor neuron disease and anaphylaxis).

ANH-UK point out that "until the known risks are properly communicated to the public, informed choice does not exist. We call on recipients of this eBlast to communicate with your parliamentary representative, whether in the UK, or other European countries, the US, Canada, Australia or elsewhere, and put pressure on your government to release all the known facts over the risk of this controversial vaccine --- or initiate a scientific inquiry."

According to a new Associated Press-GfK poll, only 52% of Americans are willing to be given the H1N1 vaccine. It seems that people are getting the message that vaccines, while worthwhile, are neither 100% safe nor 100% effective. Consumers want to make important healthcare choices for themselves, rather than be coerced by government mandates.

As for the British teen who lives with her grandmother in the United States and seeks US citizenship, there is hope. According to vaccine lawyer Patricia Finn, there is a provision in immigration law that allows rejection of vaccination on all kinds of moral or religious grounds. Attorneys like Finn help to defend the rights of those who choose to opt out of vaccinations, such as Gardasil and its British version, Cervarix, with its imperfect record of safety.

Redskins Cheerleader Permanently Disabled by Flu Shot

Desiree Jennings, 26, was a healthy Washington Redskins cheerleader who was training for a marathon when she was stricken with permanently debilitating symptoms following a flu shot administered in a local grocery store.
Here's her story in two parts.


Doctors have diagnosed her with Dystonia, a disabling disease for which there is no cure. Although the reports state that Desiree's reaction is rare, it doesn't make it any less significant and shouldn't diminish the deleterious impact on her future quality of life and of the lives of those around her.
